A divorce ends your marriage, but it doesn’t end your financial relationship with your ex-partner and if you don’t end that relationship your ex-partner will be entitled to apply for financial settlement until they either die or re-marry irrelevant of whether you are divorced or not.This means if you get a new job, re-marry, get a pay-rise, inherit money or you win the lottery in the future then they may apply to the court for a share of any new wealth you acquire. This could be 20 years after your divorce.
If you can agree on how to end your financial relationship when you get divorced the quickest and cheapest way of sorting out your finances is always to apply for a consent order. This sets out how to share your marital assets and prevents any financial claims against you in the future.
A consent order is a form of financial contract which records a financial agreement and severs the financial ties between a married couple. It explains how your assets will be divided, such as money, property, pensions, investments, savings and could include details of any spousal maintenance or child maintenance payments.
A Consent Order is a legally binding agreement that will be:
• drafted by a solicitor;
• signed by you and your ex-partner after you have both provided financial disclosure; and
• is sense-checked by a family court judge.
Cost:
We offer a basic consent order as the default package. This covers basic needs common for most couples such as the sale of the family home or one person buying the other out of the family home so they can keep it.
You can add on separate types of orders as bolt-ons, for example, pension sharing orders, spousal or child maintenance and delayed sale of a property.
If you need anything beyond that, for example, you have a portfolio of rental properties, a business, complicated finances etc please contact us for a quote. Al our orders:-
• are fully compliant with any proceedings in England and Wales
• comply with the standard practise directions
• are agreed in draft by you before submission
• Include costs for submission to the court
We can liaise with your spouse on the draft order on its terms, signing and submission for an extra cost if required.
Buyers should not the submission of a consent order to the court attracts a separate fee applied by HMCTS which is not included in our price. This fee is currently £53.
